Alabama General Warranty Deed Signing Requirements

The form must be completed and signed by a grantor who is capable of writing their name. This should be done in the presence of either one (1) witness or a Notary Public. In the event that the grantor is unable to write their own name or declines to do so, the execution must be witnessed by two (2) witnesses or a notary public. Additionally, if the grantor is married, the presence of the spouse along with a witness or notary public is required.

Alabama General Warranty Deed State Laws

Section 35-4-20 outlines the requirements for written conveyances involving the transfer of land. The conveyance document must be written or printed on parchment or paper, and it needs to be signed at the bottom by the person making the transfer or their authorized agent. If the person cannot sign their name, it can be written for them with the notation "his mark." The execution of the conveyance must be witnessed by one person, or if the party cannot write, by two witnesses who are capable of writing and must sign their names as witnesses. If the person can write but chooses not to do so, and someone else writes their name, then two witnesses who can and do write their names are required to attest the execution.
